1. Introduction

Thank you for choosing e-Affidavit Services for your affidavit deposition needs. These Terms and Conditions ("Terms") govern the use of our services. By accessing or using our platform, you agree to comply with these Terms. If you disagree with any part of these terms, please discontinue use of the platform.

2. Services Offered

The e-Affidavit Platform provides the following services:

  • Affidavit Templates: Access and modify a range of affidavit templates for various needs. Users may personalize the templates with accurate information, submit, and obtain their affidavits through the platform.
  • Oaths and Affidavit Deposition: We assist with preparing and swearing affidavits, which are witnessed by a Commissioner for Oaths who administers the oath and confirms your identity.
  • Video Conferencing: The platform uses an integrated video conferencing tool to schedule and conduct virtual meetings for online notarization, enabling instant connections with a Commissioner for Oaths, who will witness and attest to the affidavit, ensuring its authenticity
  • Electronic Signature and Stamping: Affidavits are electronically signed and stamped for legal validity. Users receive an electronically signed copy for their records.
  • Affidavit Verification: Affidavits generated on the platform are assigned a unique verification ID, allowing third parties to confirm their authenticity by entering the ID in our Verify Affidavit menu.

3. Fees and Payment

Payment for services is due at the time a deponent submits an affidavit to the Commission. We accept debit cards and other recognized payment methods through third-party payment service providers.

4. Identification Requirements

All users seeking an affidavit signed and stamped by the Commissioner for Oaths must present a valid government-issued photo ID (e.g., driver’s license, national ID, voter’s card, or passport) during the virtual meeting.

5. Document Requirements

  • Affidavits must be complete, true, and free of errors, as required by state oaths laws.
  • Passport photographs or headshots of deponents are also needed.

6. Regulatory conformity and compliance

We aim to ensure that affidavits generated and administered through our platform comply with applicable oath laws.

Users must access and use the platform only for lawful, authorized, and acceptable purposes. Prohibited activities include:

  • Violating or infringing on the rights of others, including intellectual property or privacy rights.
  • Engaging in fraud, financial crimes, money laundering, or other illegal activities.
  • Publishing false or misleading information.

8. Intellectual Property

All content on the e-Affidavit Platform, including text, graphics, trademarks, logos, and design elements, is owned or licensed by LexTech Ecosystems Limited and is protected by copyright, patent, and trademark laws. Unauthorized use, reproduction, or distribution is prohibited.

9. Third Party Services

Our platform may integrate with third-party services (e.g., payment gateways). These Terms and our Privacy Policy apply solely to our services. When using third-party services, their respective terms and policies will govern your use of those services.

10. Accuracy of Information

Users are responsible for ensuring that all information provided to the platform is accurate and complete.

11. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ACCURACY, TIMELINESS, COMPLETENESS, OR FITNESS FOR A PARTICULAR PURPOSE. USERS ASSUME ALL RISK ASSOCIATED WITH USING THE PLATFORM.

12. Limitation of Liability

WE ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF OUR SERVICES.

13. Indemnification

By using our services, you agree to indemnify and hold harmless Enugu State Judiciary, its affiliates, officers, agents, and employees from any claims, liabilities, damages, or expenses arising out of or related to your use of the platform or violation of these Terms.

14. Confidentiality

We maintain the confidentiality of user information, subject to applicable laws and regulations.

15. Termination

We reserve the right to terminate or suspend your account at any time, with or without notice, if you violate these Terms or engage in unlawful activities.

16. Governing Law

These Terms shall be governed by the Oaths Act of the Federal Republic of Nigeria and applicable state laws where relevant.

17. Dispute Resolution

In the event of a dispute arising out of or related to these Terms or your use of the e-Affidavit Platform, the parties agree to first attempt to resolve the dispute through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall then be submitted to mediation in Nigeria, in accordance with the rules of a recognized alternative dispute resolution (ADR) institution. If mediation fails, the dispute shall be finally settled by arbitration in Nigeria in accordance with the Arbitration and Mediation Act 2023. Each party shall bear its own costs and expenses, except as may be otherwise determined by the arbitrator.

The language of mediation and arbitration shall be English.

18. Force Majeure

The e-Affidavit Platform shall not be held liable for any failure or delay in the performance of its obligations under this Agreement due to causes beyond its reasonable control, including but not limited to:

  • Natural disasters (e.g., earthquakes, floods, storms)
  • Power outages or interruptions in utility services
  • Internet or telecommunication service disruptions affecting platform access
  • Cyber-attacks, data breaches, or system failures
  • Acts of war, terrorism, civil unrest, or changes in government regulations
  • Pandemics, epidemics, or public health emergencies
  • Strike actions, labor disputes, or force majeure events affecting third-party service providers

In the event of a Force Majeure, the platform will promptly notify users of the occurrence of such an event and make reasonable efforts to resume services as soon as possible.

If the Force Majeure event persists, the platform reserves the right to temporarily suspend, extend, or modify the service, or, if necessary, terminate service delivery without penalty to the users.

During the Force Majeure event, the platform’s performance obligations shall be suspended for the duration of the event, and the platform will not be held liable for any delays or non-performance arising from such events.

19. Entire Agreement

These Terms constitute the entire agreement between you and LexTech Ecosystems Limited, superseding all prior communications, representations, or agreements.

20. Amendments

We may amend these Terms at any time by posting the revised Terms on our website. Continued use of the platform signifies acceptance of these changes

21. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
